CONTEST RULES


1. The "Food for Thought" Contest (the "Contest"), held by Dairy Farmers of Canada (the "Contest Organizer"), will run from February 28, 2014, to March 28, 2014, at 11:59:59 p.m. (ET) (the "Contest Period") on the Internet at www.allyouneedischeese.ca/survey.

ELIGIBILITY

2. The Contest is open to any person residing in Canada, except in the province of Quebec or the territories, who has reached the age of majority in his/her province at the time of entry. Employees, agents and representatives of the Contest Organizer, of any company, corporation, trust or other legal entity controlled by or affiliated to it, their advertising and promotional agencies, suppliers of the prize, materials or services related to this Contest, or of any person or entity directly related thereto, as well as members of their immediate family (brothers, sisters, children, father, mother), their legal or common-law spouse and any individuals with whom such employees, agents and representatives are domiciled, are not eligible to participate in the Contest. In order to enter the Contest, the settings on your computer must allow “cookies” from our website.

HOW TO ENTER

3. To enter, proceed as follows:

  1. 3.1 During the Contest Period, visit our website at www.allyouneedischeese.ca/survey;

  2. 3.2 Follow the instructions and complete the electronic survey;

  3. 3.3 Fill out the section where you are required to provide your first name, last name, complete address (including the city, postal code and province), home phone number and email address (the "Entry Form");

  4. 3.4 Declare that you have read and agree to the Contest rules by checking the appropriate box; and

  5. 3.5 Click on "Enter" to send your Entry Form no later than March 28, 2014, at 11:59:59 p.m. (ET). Registration in the Contest will be completed upon receipt of a message thanking you for your entry.

4. Limited number of surveys. When the maximum number of survey participants has been reached, as set by the Contest Organizer, entrants will be informed that quotas have been filled and will not be prompted to fill out the survey, but will nevertheless be entered in the Contest. Participants in the Contest will be informed of such a situation when providing their personal information as described above.

5. Additional limitation. Participation in the Contest is limited to one (1) entry per household throughout the Contest Period.

PRIZE

6. Prize description. One (1) grand prize will be awarded, consisting of one (1) or more gift cards of a total value of $5,000 CAD redeemable at a grocery store.

7. Limit. The following conditions apply to the prize:

  1. 7.1 The choice of the grocery store where the gift card may be redeemed is at the sole discretion of the Contest Organizer.

  2. 7.2 The gift card may not be exchanged in whole or in part for cash, may not be combined with any other promotion or offer and is subject to any other restrictions or conditions stipulated on it or which may be communicated to the winner by its issuer.

8. Drawing procedures. One (1) entry will be selected through a random draw out of all entries duly registered during the Contest Period. The draw will be held at 10:00 a.m. (ET) on April 7, 2014, at Attitude Marketing’s offices located in Longueuil, Quebec.

9. Odds of winning. The odds of an entrant’s entry being selected to win the prize depend on the number of eligible entries registered during the Contest Period.

10. Awarding of the prize. To be declared the winner of the prize, an entrant must:

  1. 10.1 be contacted by telephone or email, at the sole discretion of the Contest Organizer, within seven (7) days of the draw;

  2. 10.2 fill out and sign the declaration and release form (the "Declaration Form") that the Contest Organizer will provide him/her by fax, email or mail and return it to the Contest Organizer within ten (10) days of its postmark;

  3. 10.3 have correctly answered the mathematical skill-testing question appearing on the Declaration Form; and

  4. 10.4 provide the Contest Organizer with sufficient identification attesting the entrant’s name and age, as well as a proof of place of residence, upon request and in a timely manner.

11. Failure to comply. Failure to comply with any of the conditions of these Contest rules or refusal of the prize will cause the concerned entrant to be automatically disqualified. In such case, the Contest Organizer, may, at its sole discretion, cancel the prize or hold a new random draw to award the prize according to these Contest rules until an entrant is selected and declared a winner.

12. Within two (2) to four (4) weeks following the receipt of the duly completed and signed Declaration Form, the Contest Organizer will inform the winner of how to claim his or her prize.

GENERAL CONDITIONS

13. Liability limit: participation in contest and use of prize. By participating, entrants release and hold harmless the Contest Organizer, any company, corporation, trust or other legal entity controlled by or affiliated to them, their advertising and promotional agencies, their employees, agents and representatives (collectively, the "Releasees") from and against any liability, claims, damages, demands, actions, or causes of action whatsoever which they, their heirs, successors, assigns, executors, or administrators may now or hereafter have against any of the Releasees in respect of or relating to the Contest, their entry or their attempt to enter the Contest, and/or the acceptance, use, misuse, or possession of the prize. To be declared a winner, and prior to obtaining his/her prize, the entrant selected to win a prize must sign a statement to this effect on the Declaration Form.

14. Liability limit: conduct of the Contest. The Releasees shall not be responsible in any event, directly or indirectly, in whole or in part, for any print, typographical or reproduction errors in any Contest-related materials; and any damages or loss that may be caused by the downloading of any web page or by the transmission of any information related to the participation in the Contest. Without limitation to any of the foregoing, the Releasees shall not be at any time responsible, directly or indirectly, in whole or in part, for the following that may limit or prevent any entrant’s participation in the Contest: malfunctioning of any computer component, software or communications line; loss or lack of a communications network; or any transmission that is faulty, incomplete, incomprehensible or erased by any computer or network.

15. Website. The Contest Organizer does not warrant that access to or use of the Contest website will be uninterrupted during the Contest Period or error-free.

16. Contest modification. The Contest Organizer reserves the right, at its sole discretion, to cancel, modify or suspend this Contest in whole or in part, or to terminate it, should any intervention or event modify or affect the administration, security, impartiality or conducting of the Contest in accordance with these Contest rules. In the event that some of the Contest entries have not been received during the Contest Period for any reason whatsoever, or if participation in the Contest must be terminated in whole or in part before the end of the Contest Period, the Contest Organizer will proceed with the draw among the entries duly registered during the Contest Period or, as the case may be, up to the date of the event terminating the Contest.

17. Verification. All Entry Forms and Declaration Forms are subject to verification by the Contest Organizer. Any Entry Form or Declaration Form which is, as the case may be, incomplete, illegible, fraudulent, forged, falsified, registered or submitted late, bearing an invalid phone number, not bearing the correct answer to the mathematical skill-testing question, or otherwise noncompliant with any of the applicable provisions contained in these Contest rules shall be rejected by the Contest Organizer and will not entitle the entrant to be registered in the Contest or to win the prize, as the case may be.

18. Disqualification. The Contest Organizer reserves the right, at its sole discretion and without notice, to disqualify an entrant or to cancel any entry of an entrant who is suspected of attempting to defraud the Contest or participates or tries to participate in this Contest by using methods that do not comply with these Contest rules or that are unfair to the other entrants. In such a case, the Contest Organizer reserves the right to report the actions of such entrant to the appropriate legal authorities and to obtain legal or equitable relief under applicable laws.

19. Acceptance of prize. The prize must be accepted as described in these Contest rules and may not be transferred to another person, replaced by another prize or exchanged in whole or in part for cash, except as provided below.

20. Liability limit: prize supplier. Any entrant selected for the prize acknowledges that upon awarding of the gift card, the obligations related to it become the responsibility of its issuer.

21. Substitution of prize. In the event that it is impossible, difficult and/or more costly for the Contest Organizer to award the prize as described in these Contest rules, the Contest Organizer reserves the right to replace the prize with one of the same kind and of equivalent value or, at its sole discretion, with the cash value of the prize as indicated in the Contest rules.

22. Prize limit. In no event shall the Contest Organizer, of any company, corporation, trust or other legal entity controlled by or affiliated to it, their advertising and promotional agencies, the suppliers of the prize, materials or services related to this Contest be required to award more prizes than indicated in these Contest rules or to award a prize otherwise than in compliance with these Contest rules.

23. Authorization. Any entrant selected for a prize authorizes the Contest Organizer and its representatives to use, if required, its name, photo, likeness, statement regarding a prize, place of residence and/or voice for publicity purposes, in any and all media used by the Contest Organizer and its representatives, without additional compensation. A statement to this effect will be included in the Declaration Form.

24. Contest Organizer’s decision. Any decision by the Contest Organizer or its representatives regarding this Contest is final and without appeal.

25. Entrant identification. For the purposes of these Contest rules, the entrant is the person whose personal information appears on the Entry Form. The prize will be awarded to this person if he/she is selected and declared a winner.

26. Communication with entrants. No communication or correspondence related to this Contest shall be exchanged with entrants except as provided for in the present Contest rules or at the Contest Organizer’s initiative.

27. Property. Entry Forms and Declaration Forms are the sole property of the Contest Organizer and shall not in any case be returned to the entrants.

28. Personal information. Entrants’ personal information collected for the purposes of entering the Contest will be used only to administer the Contest. Information provided by entrants when they complete the survey will not be associated with the personal information entrants provide through the Entry Form. No commercial or other communications unrelated to the Contest will be sent to entrants, unless they have otherwise agreed to receive such communications.

29. If a section of the Contest rules is declared or deemed illegal, unenforceable or invalid by a competent court, that section shall be considered invalid, but all unaffected sections will be applied within the limits of the law.
